Welcome to the Physicians for Informed Consent Forum (PIC Forum) at forum.physiciansforinformedconsent.org (Website). By using this Website, you agree to these Terms of Use.

These Terms of Use are an agreement or general understanding between the parties, Physicians for Informed Consent (Organization) and approved PIC MD/DO Members (Members). If you do not agree with these Terms of Use, please do not use this Website, or contact us in writing to present a mutual understanding we can accept in writing.

This PIC Forum is a private online forum exclusively for PIC medical doctors and PIC osteopathic doctors. You agree to keep confidential the contents of the PIC Forum. As specified in more detail below, you retain all your intellectual property rights in any content or writings you post on the forum; likewise, you will respect the intellectual property rights in any content or writings posted by other forum members.
 

Site Use

This Website is provided solely for PIC Members for educational and organizational purposes. Any other use of this Website is prohibited. The following are expressly prohibited uses of this
Website:

• unauthorized use or disclosure of private, personally identifiable health information of others
• post content in an inappropriate or inapplicable category
• post content that is materially false, misleading, obscene, harassing, libelous, or defamatory
• post any unsolicited and irrelevant advertisement, spam, chain letter, or other similar type of information;
• post any materials subject to trademark, copyright, or other laws protecting any materials or data of others in the absence of a valid license or other right to do so.
• harvest or otherwise collect information about users, including email addresses, without their consent
• distribute a virus that may harm the Website, or the interests or property of Website users
• use any robot, spider, scraper, or other automated means to the Website for any purpose without PIC’s written permission
• take any action that imposes or may impose (in the sole discretion of PIC) an unreasonable or disproportionately large load on PIC infrastructure
• copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for the parties’ information) from the Website without the prior express written permission of PIC and the appropriate third party, as applicable;
• unreasonably violate any applicable laws, third party rights or PIC policies
   

The contents of the Forum, including but not limited to writings are for information purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Privacy and Website Security

You are responsible for updating your personal contact information and maintaining the security of your user identification, password, and other confidential information relating to your account.

In the event of any unauthorized use, you shall immediately notify PIC and take proactive steps to remedy the unauthorized use and prevent reoccurrence.

Except where expressly provided otherwise by PIC, all content submitted to the PIC Forum (“Submissions”) shall be considered private, and PIC shall be free to use such Submissions on a reasonable basis within the private PIC Forum or as provided by an agreement with the party submitting the content. You acknowledge that you are responsible for your Submissions’ copyright and legal compliance, as well as reliability and appropriateness. PIC respects fair use.

PIC may, but is not obligated to, monitor areas on the Forum where users post video and communications. To the fullest extent of the law, PIC will not be liable for the content of such video and communications, whether or not arising under the laws of copyright, libel, privacy, or otherwise.

The content on this Website is provided “as is” and PIC disclaims all express and implied representations, warranties, and guaranties, to the fullest extent allowed by law, including without limitation with regard to quality, copyright, suitability, accuracy, and completeness. This same disclaimer applies with equal force to content provided by users.

Limitation of Liability

To the fullest extent allowed by law, under no circumstances and under no legal theory, whether in tort, contract, or otherwise, shall PIC be liable to you or to any other person for loss of profits, loss of goodwill, or any indirect, special, incidental, or consequential damages, or damages for negligence of any character including, without limitation, damages for loss of goodwill, work stoppage, loss of data, computer or network failure or malfunction, or for any other damage or loss.

Content Ownership and License

When you submit content to the PIC Forum, you retain all copyright and intellectual property rights in your content. You shall comply with all copyright laws worldwide in your use of this Website and prevent unauthorized copying of the Materials.

PIC does not grant you any express or implied right in PIC-provided content including but not limited to the PIC logo.

When you submit content to the PIC Forum, you grant PIC a nonexclusive, worldwide, royalty- free, perpetual license to utilize the content, and any excerpts therefrom, for private forum purposes in PIC’s reasonable discretion.

Indemnity

You agree to indemnify, defend, and hold harmless PIC, its affiliates, agents, employees, and licensors from and against any and all claims and expenses, including reasonable attorney fees, arising out of or related in any way to your use of the forum, violation of this Agreement, violation of any law or regulation, or violation of any proprietary or privacy right.

Term

Without limiting its other remedies, PIC may immediately discontinue, suspend, terminate, or block your and any user’s access to this Website at any time in PIC’s sole discretion.

As a convenience to you, the forum may contain links to websites operated by other entities (collectively the “Linked Sites”). If you use any Linked Sites, you will leave this Website. If you decide to visit any Linked Site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements.

California Law

PIC operates this Website from California and makes no representation that the Content is available for use outside the United States of America. If you access this Website from another location, it is by your own initiative and it is your responsibility to comply with the laws of your jurisdiction. These terms of use shall be interpreted and governed by California law, and jurisdiction of any action arising out of or relating to these terms shall be set in Orange County, California.

PIC may make improvements and/or changes to the Forum and content on this Website at anytime and without notice.
